A Valero Energy subsidiary sued the federal government 3 times this year over taxes, alleging the IRS failed to act on refund claims of more than $177 million.

A Valero Energy Corp. marketing subsidiary has sued the federal government three times this year in an attempt to recover more than $177 million in taxes it says it overpaid from second quarter 2014 through 2017. Valero Marketing and Supply Co.

Valero profit down in the first quarter but beats analysts’ expectations Valero Marketing filed a similar lawsuit in 2019. In that case, the company sued over nearly $122 million in alleged overpayments of fuel excise tax in first quarter 2015. The court granted a partial summary judgment in the company’s favor. It awarded almost $1.5 million, plus unspecified interest, and closed the case. Valero Marketing appealed the judgment and a ruling against it to the 5th U.S. Circuit Court of Appeals.
