The Supreme Court has dismissed an appeal against An Bord Pleanála's decision to grant planning permission for a solar energy-generating facility in the Midlands.
In its judgement, a five judge Supreme Court dismissed all aspects of the appeal after finding that the substantive issues raised were either"misconceived" or"premature". The judge said that the fact hedgerows were removed did not trigger an obligation to to have an EIA in respect of the whole project.
