Absolute Nonsense! It is not the Court that excluded DMRE jurisdiction on Mining Surface Operations, it is Parliament when it excluded these operations from the definition of a “Mine” in the MPRDA.What the DMRE was to do thereafter was to amend that definition to be inclusive.
