The court ruled by majority on Wednesday Victoria's Zero and Low Emission Vehicle Distance-based Charge Act 2021 was invalid.
But Christopher Vanderstock and Kathleen Davies, who were issued with the charge, challenged the validity of the tax in the High Court on the basis it was unconstitutional. Mr Vanderstock, who was represented by Equity Generation Lawyers along with Ms Davies, said in a statement the High Court decision was"a great outcome not only for Victorian electric vehicle drivers but for all Australians".
"We hope that today's decision is a step in the right direction towards a cleaner, lower emissions future."The High Court has this morning found that Victoriaâs electric vehicle tax is unconstitutional. The decision means that Victoriaâs electric vehicle tax is invalid.The Electric Vehicle Council said while there was"nothing inherently wrong with road user charges", they should not"discourage the take up of electric vehicles".
"It is beyond ridiculous that Labor in Victoria is trying to make it harder and more expensive for people to bring down transport emissions and switch to electric cars," transport spokesperson Katherine Copsey said in a statement.
