The release of the legal question the countries want to be taken up by the International Court of Justice marks a milestone in the years-long effort by Vanuatu to get legal clarification for all countries regarding the impacts of climate change.
It will also ask the court to define what the legal consequences under these obligations are for states, which through their acts or lack of action, have caused harm to the climate system. ICJ advisory proceedings involve a series of hearings, which give a platform to all countries to provide evidence. An advisory opinion would not request compensation or reparations, the Vanuatu government said.
