THE convergence of liberal political ideas and laissez faire economic philosophy and their transportation into the realm of human rights, have blurred the distinction between right and wrong, and morality and immorality.

This categorisation of states according to their standpoints on human rights have further sharpened the division between the so-called democratic governments and the so-called authoritarian regimes. Herein lies the dilemma of the developing countries in adjusting their perceptions and postures towards human rights. It is therefore apparent that both normative considerations and ideological tendencies are driving the discourses on international human rights today.

These divisions naturally have tended towards the invocation of sovereignty of states to decide which “rights” to promote, protect or enforce within their territorial jurisdictions, and which ones to legislate against as demanded by their national sentiments or outlooks. Nigeria’s standpoint on the so-called same-sex marriages and the Federal Government’s legislation against it, have led to severe censuring of the country and the government of the day by the major Western powers.

As a result, state sovereignty became a subject of discussion in relation to its limits and scope when associated with human rights concerns. States are sovereign by virtue of their being so as recognised by international law and practice. However, the idea or concept of sovereignty comes with certain responsibilities and limitations in terms of the behaviour of states under particular circumstances.
